Terms of Service

1. Acceptance of Terms

By registering for or using PowerInsight ("the Service"), operated by PowerWorks Energy Sweden AB (organization number 559337-8838) at Auroragränd 1, 127 61 Skärholmen, Sweden, you ("the user," "you") agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

2. Description of the Service

PowerInsight is a monitoring portal designed for owners of Battery Energy Storage Systems (BESS) and customers who have a service agreement that includes access to PowerInsight. The portal displays battery performance and can generate monthly performance reports for your BESS portfolio. PowerInsight is currently available only in Sweden.

3. Eligibility and Access

Business Customers Only: You must be a customer of PowerWorks Energy Sweden AB, either having purchased a BESS or holding a valid service agreement that includes this service.

Location: PowerInsight is intended for use within Sweden.

Minimum Age: While it is a B2B service, individual users must be at least 18 years old or the legal age in their jurisdiction.

4. User Accounts

Account Creation: Provide accurate and up-to-date information, including your name and email address.

Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately if you suspect unauthorized access.

5. Acceptable Use

You agree to use PowerInsight solely for monitoring and analyzing your BESS performance. You will not:

• Use the Service for unlawful, fraudulent, or malicious activities.
• Interfere with the Service's security features or other users' access.
• Reverse-engineer or extract source code from the Service.

6. Additional Services: Guarantees of Origin Reporting

Voluntary Opt-In: If your BESS is connected to renewable energy production and you request us to do so, we can report your energy data to the Swedish Energy Agency's Cesar system.

Customer Responsibilities:

• You must designate PowerWorks Energy Sweden AB as your delegate/agent.
• You must register an account with the Swedish Energy Agency and obtain the necessary credentials.
• You must provide your meteringPointId (Anläggnings ID) for the relevant energy meters.

Scope of Our Role: We will submit the required data to the Swedish Energy Agency solely for reporting guarantees of origin. We assume no liability for errors or omissions if the information provided to us is incomplete or inaccurate.

7. Intellectual Property Rights

All content, code, and trademarks related to the Service are owned or licensed by PowerWorks Energy Sweden AB. You may not reproduce, distribute, or modify any part of the Service without express written consent.

8. Privacy and Data Protection

Your personal data is handled in accordance with our Privacy Policy, which is part of these Terms by reference. By using PowerInsight, you acknowledge and agree to our data practices.

9. Disclaimer of Warranties

PowerInsight is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free service or that it will meet your expectations. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by Swedish law, PowerWorks Energy Sweden AB and its affiliates shall not be liable for any indirect, consequential, or incidental damages arising from or related to your use of PowerInsight. Our total liability for any claim is limited to the amount (if any) you paid for using PowerInsight.

11. Termination

We reserve the right to suspend or terminate your access to PowerInsight at any time, without prior notice, if you violate these Terms or engage in conduct that could harm the Service, other users, or our reputation.

12. Governing Law and Dispute Resolution

These Terms and any disputes arising from them or the Service are governed by Swedish law. Any dispute shall be resolved in the Swedish courts, unless otherwise required by applicable local law.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on our website and update the "Last Updated" date. Continuing to use PowerInsight after changes become effective constitutes acceptance of the updated Terms.
